The State of BEAD Post-Election - Key Updates and Implications

As the BEAD (Broadband Equity, Access, and Deployment) initiative progresses, significant milestones and evolving dynamics continue to shape the broadband landscape. Here's an overview of the latest developments and insights discussed during a recent industry fireside chat led by Ashley Travers of KGPCo and Lori Adams of Nokia.

Milestones and Progress

All 56 states and territories have successfully obtained approval for their Volume 2 plans, marking a critical transition into the implementation phase. Lori Adams of Nokia emphasized the urgency:

"For folks who've been thinking BEAD is in the future, BEAD is happening—and happening fast. Every state and territory now has their Volume 2 approved, and we're seeing states move quickly into implementation, with several already opening and even closing their grant windows."

Louisiana has notably led the charge, distributing funds to qualified recipients, with the majority allocated to fiber-based technologies. Its approach serves as a template for other states as they move forward.

Impacts of the Election

The post-election landscape brings continuity at the state level, with no major party shifts in governorships. This stability supports the consistent implementation of state broadband plans. At the federal level, leadership changes, including potential new appointments such as Howard Lutnick for the Department of Commerce, signal ongoing adaptation. Despite these shifts, the emphasis remains on accelerating approvals and awards to meet upcoming deadlines.

Challenges and Strategic Insights

Supply chain concerns, including the potential impact of tariffs and Buy America Build America (BABA) requirements, remain significant hurdles. To navigate these challenges, early decision-making and proactive ordering of materials are vital. Ashley Travers highlighted the need for urgency:

"When the ISPs are talking to the state broadband offices, it’s critical to make sure they can make decisions as soon as possible. Without materials locked in early, crews can’t build, and that creates a world of hurt."

Additionally, the BEAD program remains primarily focused on fiber-based technologies, but flexibility is built in. As Lori Adams explained:

"The BEAD program is fiber-first, but mechanisms are already in place for states to consider alternate technologies where needed. It’s about reaching as far as possible with fiber while allowing flexibility where it makes sense."

BABA Compliance: What You Need to Know

BABA compliance is a firm requirement for BEAD-funded projects. While the 55% domestic content rule has been waived for broadband electronics due to global supply chain dependencies, applicants must still ensure adherence to compliance standards. Certification and proper documentation are essential. Ashley Travers reiterated KGPCo’s commitment:

"As a distributor, it’s on us to ensure customers have access to BABA-compliant products when required. It’s all about getting the right materials for the right projects, so work can progress without delays."

Looking Ahead 

As the April 2025 deadline for awarding state funds approaches, the urgency to finalize processes and secure resources intensifies. Provisional guidance expected from NTIA may allow awardees to begin pre-construction activities such as permitting and environmental assessments, expediting progress.
